Who Is Eligible for Adjustment of Status?

The United States offers lawful permanent resident status to many immigrants who are already present in the country. You may be eligible for adjustment of status if you:

  • Are in the United States with a nonimmigrant visa (such as a student or worker visa)
  • Have been in the United States for at least one year
  • Are married to a U.S. citizen
  • Are the unmarried child of a U.S. citizen
  • Are the unmarried child of a lawful permanent resident
  • Are a lawful permanent resident who has been in the country for at least 5 years
  • Are the spouse or child of a U.S. citizen who is serving in the military
  • Are a national of the United States
